This 8ball games Subscriber Agreement ("Agreement") is a legal document that explains your rights and obligations as a subscriber of 8ball games community. Please read it carefully.
1 APPLICATION OF TERMS TO YOU
8ball games community is an online service. You become a subscriber of 8ball games community ("Subscriber") by completing the registration of a 8ball games community user account. This Agreement takes effect as soon as you indicate your acceptance of these terms. You may not become a subscriber if you are under the age of 13. 8ball games is not intended for children under 13 will not knowingly collect personal information from children under the age of 13.
2 Your Account
When you complete 8ball games community’s registration process, you create a 8ball games community account ("Account"). You account also include the mail address and other informations that can be used, from 8ball games, for some communications of various genre and it should be shared with some partners. You may not reveal, share or otherwise allow others to use your password or Account except as otherwise specifically authorized by 8ball games. You are responsible for the confidentiality of your login and password and for the security of your computer system. 8ball games is not responsible for the use of your password and Account or for all of the communication and activity on 8ball games community that results from use of your login name and password by you, by any person to whom you may have intentionally or by negligence disclosed your login and/or password in violation of this confidentiality provision. Unless it results from 8ball games’ negligence or fault, ball games is not responsible for the use of your Account by a person who fraudulently used your login and password without your permission. If you believe that the confidentiality of your login and/or password may have been compromised, you must notify 8ball games via the support form without any delay. Your Account, including any information pertaining to it (e.g.: contact information, billing information, Account history and Subscriptions, etc.), is strictly personal. You may therefore not sell or charge others for the right to use your Account, or otherwise transfer your Account, nor may you sell, charge others for the right to use, or transfer any Subscriptions other than if and as expressly permitted by this Agreement (including any Subscription Terms or Rules of Use) or as otherwise specifically permitted by 8ball games.
3 ONLINE CONDUCT, CHEATING AND ILLEGAL BEHAVIOR
Your online conduct and interaction with other Subscribers should be guided by common sense and basic etiquette. They must notably comply with the 8ball games community Online Conduct rules. Depending on terms of use imposed by third parties who host particular games or other services, additional requirements may also be provided in the Subscription Terms applicable to a particular Subscription. 8ball games community and the Content and Services may include functionality designed to identify software or hardware processes or functionality that may give a player an unfair competitive advantage when playing multiplayer versions of any Content and Services or modifications of Content and Services (“Cheats”). You agree that you will not create Cheats or assist third parties in any way to create or use Cheats. You agree that you will not directly or indirectly disable, circumvent, or otherwise interfere with the operation of software designed to prevent or report the use of Cheats. You acknowledge and agree that either 8ball games or any online multiplayer host may refuse to allow you to participate in certain online multiplayer games if you use Cheats in connection with 8ball games community or the Content and Services. Further, you acknowledge and agree that an online multiplayer host may report your use of Cheats to 8ball games, and 8ball games may communicate your history of use of Cheats to other online multiplayer hosts. 8ball games may terminate your Account or a particular Subscription for any conduct or activity that is illegal, constitutes a Cheat, or otherwise negatively affects the enjoyment of 8ball games by other Subscribers. You acknowledge that 8ball games is not required to provide you notice before terminating your Subscription(s) and/or Account. You may not use Cheats, automation software (bots), mods, hacks, or any other unauthorized third-party software, to modify or automate any Subscription Marketplace process.
3.1 ONLINE CONDUCT OF 8ball games ©
As a 8ball games community subscriber you agree to abide by the following conduct rules. You will not: Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same. Use any material or information, including images or photographs, via 8ball games community in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party. Upload files that contain viruses, trojan horses, worms, or any other similar software or programs that may damage the operation of another's device or property of another. Institute attacks upon a 8ball games server or otherwise disrupt 8ball games community and related services. Use 8ball games community in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise). Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Restrict or inhibit any other user from using and enjoying 8ball games community services, software or other content. Harvest or otherwise collect information about others, including e-mail addresses. Create a false identity for the purpose of misleading others. Violate any applicable laws or regulations.
4 TERM AND TERMINATION
4.1 Term
The term of this Agreement (the "Term") commences on the date you first indicate your acceptance of these terms, and will continue in effect until otherwise terminated in accordance with this Agreement.
4.2 Termination by You
You may cancel your Account at any time. You may cease use of a Subscription at any time or, if you choose, you may request that 8ball games terminate your access to a Subscription. However, Subscriptions are not transferable, and even if your access to a Subscription for a particular game or application is terminated, the original activation key will not be able to be registered to any other account, even if the Subscription was obtained in a retail store. Access to Subscriptions purchased as a part of a pack or bundle cannot be terminated individually, termination of access to one game within the bundle will result in termination of access to all games purchased in the pack. Your cancellation of an Account, or your cessation of use of any Subscription or request that access to a Subscription be terminated, will not entitle you to any refund, including of any Subscription fees. 8ball games reserves the right to collect fees, surcharges or costs incurred prior to the cancellation of your Account or termination of your access to a particular Subscription. In addition, you are responsible for any charges incurred to third-party vendors or content providers before your cancellation.
4.3 Termination by 8ball games
8ball games may cancel your Account or any particular Subscription(s) at any time in the event that (a) 8ball games ceases providing such Subscriptions to similarly situated Subscribers generally, or (b) you breach any terms of this Agreement (including any Subscription Terms or Rules of Use). In the event that your Account or a particular Subscription is terminated or cancelled by 8ball games for a violation of this Agreement or improper or illegal activity, no refund, including of any Subscription fees or of any unused coins in your 8ball games account, will be granted.
5 VARIATIONS
These conditions ca be change in the future.
6 CLASS ACTIONS
Accepting these terms you accept of not take class actions against 8ball games.
Privacy
According to the EU Regulation 679/2016 on data protection (GDPR), applicable from 25 May 2018, the processing of personal data must always be based on principles of correctness, lawfulness, transparency and protection of privacy and rights of the interested. In the following information you can see how we have implemented the new directives in order to ensure more control and protection of personal data of all our customers who have expressed interest in the activities of 8ball games. You will find what information we collect, the reasons why we process your personal data and your rights. Information pursuant to art. 13, European Regulation 679/2016 (c.d. "GDPR")
a. Owner and method of data processing
Your personal data is processed by 8ball games, 88813 Cirò (KR) - Data controller - with electronic methods.
b. Data to which the information refers
Your data, already acquired and present in the digital archives of 8ball games stored on the servers of altervista.org, and those that you can communicate during the relationship with our company. The data in question are: personal and contact details.
c. Purpose and legal basis of data processing
(i) Event and billing reporting.
The treatment is aimed at allowing the owner of information contacts for the disclosure of:- events held at our office or in other locations (Newsletter);-notices related to the activity of 8ball games.These contacts are implemented through actions designed in a personalized manner on the basis of interests and preferences expressed by the interested party on the occasion of his participation in the various initiatives of the Controller; this allows you to select - in the varied context of the initiatives conducted by 8ball games - those of actual interest of the interested party (for example, events, presentation of our products and various communications). Contact activities can be done by e-mail.
d. Data retention periods
All data processed for the purposes sub c. (i) will be retained until the termination of the relationship established and within the terms and limits set out in the applicable rules, in particular administrative, civil and fiscal. For the purposes sub c. (i) the data will be retained until the exercise of the right of opposition by the interested party; failing that, they will be kept for as long as 8ball games continue their development activities and events related to the presentation of their products.
e. Rights of the interested party
Pursuant to articles 15-22, GDPR, writing to the owner at the aforementioned postal address or e-mail [email protected], you can exercise the rights of access, consultation, rectification, cancellation and oblivion, limitation of data processing and - where appropriate - obtain transmission to another holder (data portability), as well as oppose their processing for legitimate reasons or - where appropriate - withdraw consent. Furthermore, the interested party has the right to complain to the Data Protection Authority to assert his rights. With particular reference to treatments for the purposes described under c. (i), it is specified that the interested party has the right to oppose at any time, free of charge and without giving any reasons, to the processing of his data for such purposes, and that he may exercise the right to object even separately for contact activities traditional and automated ones: if it is not specified which contact methods it refers to, the opposition to the processing of data will be understood as extended to all contact tools. This right can also be exercised by writing to the postal address of the owner or by sending an e-mail to [email protected]
